Complaint Process

What is the process?

What is a Notice of Violation (NOV)?

A Notice of Violation is a written warning notifying the owner and/or tenant of a violation. It is a request for voluntary compliance. The violation is based on the city ordinances or the adopted International Property Maintenance Codes.

What is a Violation Letter?

A Violation letter is a formal notification that the location has a violation that has not been resolved. The Violation letter provides a compliance date if the issue is not resolved and a citation to the Municipal Court is issued.

I just received this Notice of Violation.  What should I do?

The first thing you should do is read the NOV. The notice will tell you the address of the violation property, when the violation(s) were observed by the Code Enforcement Officer, and what violation(s) were present the Code Officer observed.

You may contact the Planning and Inspections Department (770-929-4280) and provide the name of the Code Enforcement Officer located at the bottom.  The Code Enforcement Officer can usually answer any question you may have about the property and the violations observed at the time of the inspection.

COMPLY WITH THE VIOLATIONS

The Code Enforcement Officer will work with you to ensure forward progress on the violation.

Non-compliance of the Violation Notice

Failure to comply with a Code Enforcement Violation Notice is punishable by a summons to Municipal court.

Citation

Once a citation is issued, it will not be rescinded and a court appearance is required. Failure to appear for a court date may result in a warrant from the Municipal Court. Per city ordinance, each day that compliance is not reached is a new violation and additional citations may be issued. If the violation remains unresolved an abatement process may be initiated with a lien being placed on the property in Superior Court.
