By accessing and utilizing certain datasets and content (collectively, the “Data”) made available by Stantec Consulting Services Inc. or one its affiliates, as applicable, (collectively, “Stantec”) and hosted on the ArcGIS Online (“AGO”) platform, you agree that:

You will abide by all applicable AGO terms and conditions;
You will take reasonable measures to safeguard the Data. This includes protecting against unauthorized access, data breaches, or any actions that could compromise the integrity of the Data;
Except with the prior written consent, you will not modify, copy, distribute, transmit, display, reproduce, publish, license, create derivative works from, transfer or sell the Data, including, but not limited to, the practices of “screen scraping”, “data scraping”, or any other activity with the purpose of extracting the Data;
Ownership of the Data remains with the party that owns such Data;
Stantec bears no responsibility in respect of the hosting, retention, recovery, archiving or deletion of the Data. You agree that your access to the Data may be restricted at any time and for any reason in Stantec’s sole discretion;
The Data is governed by the applicable privacy policy of AGO;
Stantec disclaims all warranties and conditions of any kind, whether express or implied, relating to the Data including, but not limited to, warranties or conditions of merchantability, fitness for a particular purpose and noninfringement of intellectual property rights;
The Data may have been prepared based on information provided by others. Stantec has not verified the accuracy, timeliness and/or completeness of the Data and shall not be responsible for any errors or omissions which may be incorporated in the Data as a result. Stantec assumes no responsibility for Data supplied in electronic format, and you accept full responsibility for verifying the accuracy, timeliness and completeness of the Data;
You release Stantec and its officers, employees, consultants, and agents, from all claims arising in any way from your use of the Data; and
You will indemnify and hold harmless Stantec, its affiliates, employees, directors, subconsultants and agents from any claims or liabilities that are incurred as a result of your use of the Data.
