Current Tax Rates within Tribal Lands

The landmark McGIRT v. OKLAHOMA Supreme Court decision places uncertainty onto effective tax rates for oil and gas production on Native American Lands. According to a  Reuters report  in early July 2020, one of the concerns for oil and gas operators is whether production will be subject to additional tribal taxation. Production in eastern Oklahoma is already subject to state taxation through the OTC at rates varying from 1-7%.

Operators within Tribal Lands

Of the operators potentially affected by the Court's decision, Merit Energy and XTO lead the pack with 1029 and 893 active production units respectively.
